Do I need a lawyer to write a will?
You are not required to use a lawyer, but a professionally drafted will is far less likely to be unclear, invalid or open to challenge. We make sure your intentions are properly documented and that the will is signed and witnessed correctly, which is where many home-made wills come unstuck.
What is the difference between probate and letters of administration?
Probate is the court’s confirmation of a will, granted to the executor named in it. Letters of administration are granted when there is no valid will, appointing an eligible family member to administer the estate under Victoria’s intestacy rules. We handle both. Can I contest a will if I have been left out?
Possibly. Certain people, such as a spouse or domestic partner, a child, or someone who depended on the deceased, can make a family provision claim if they have been left out of a will or not adequately provided for.
